NEXOS GE’s position regarding slanderous statements made by CPDS

Madrid, November 28, 2024 - Following the slanderous statements contained in a recent publication by the political party CPDS ("After a year of silence from NEXOS, Radio Macuto attacks CPDS for meeting with the Government", www.cpdsge.org, November 26, 2024), after deliberation by its board of directors, the NEXOS GE platform is pleased to make the following clarifications:

1. NEXOS GE is an associative organization registered under Spanish law, whose purpose is to denounce the human rights violations that occur every day in Equatorial Guinea. Its creation arose within the framework of the evaluative seminar organized by the European Parliament on June 7 of last year 2023. The conclusions of which highlighted the need to structure a framework for collaboration and coordination between all Equatorial Guinean human rights defenders.

2. To this end, NEXOS GE brings together several political and activist groups, which nevertheless maintain their own and respective agendas, for which NEXOS GE assumes no responsibility.

3. NEXOS GE has not published and does not publish anonymous columns in the press or on social networks or, in the case at hand, on the blog «Radio Macuto», although this is one of its members. Consequently, NEXOS GE does not assume, nor can it be attributed, the authorship of the publication that gives rise to the slanderous statements uttered by the CPDS party.

4. Regarding the slanderous statements made against the person of the president of NEXOS GE, it is clear that, in loyalty to his then obligation of confidentiality due to his status as a magistrate, he has never been a member of any political party on the national spectrum, nor «served the dictator», but rather he has joined the service of the judicial institution. It should be noted, therefore, that the Supreme Court of Justice is not a one-person body but a collegiate body, in which all resolutions are adopted by a majority. Its function is not to hold criminal trials, as it is a cassation body that is solely responsible for judging the application of the Law by the substantive courts.

5. Due to the imposed political subordination of the judicial power, it is public knowledge and does not require illustrating that in the substantiation of political cases, the substantive courts act under strict instructions from the dictatorship linked by the public ministry. The non-compliance leads to arbitrary arrests of judges and magistrates, torture and even murders, such as that of the magistrate Jose Esono Ndong Bindang (RIP).

6. Therefore, the NEXOS GE platform reaffirms its commitment to the defense of human rights proclaimed in the International Covenant on Civil and Political Rights and transcribed in the current constitutional order since the ratification of said international instrument by our country on September 25, 1987.

7. NEXOS GE consequently expresses its strongest rejection of any attempt to defend the political instrumentalization of the judicial system, as it is antithetical to the promotion of a democratic state of law.
